A class action lawsuit against SpaceXAI and Stability AI has expanded to five plaintiffs who allege the companies' image-generation tools were used to create child sexual abuse material without adequate safeguards. The Stepfather Case
One of the most severe allegations involves a Wyoming man who allegedly used Grok, SpaceXAI's chatbot, to generate approximately 7,000 sexually explicit images depicting his stepdaughter using a photograph taken when she was 11 years old. According to the lawsuit, the man created images depicting incest and rape without triggering the AI system's safety mechanisms. The complaint states that Grok's content filters only intervened after the man requested "gang rape" imagery, which generated an automated report to the National Center for Missing and Exploited Children.
Despite legal obligations to assist law enforcement, the lawsuit alleges that SpaceXAI repeatedly refused to provide identifying information such as the user's IP address, thereby obstructing the investigation for weeks. After law enforcement obtained a warrant to seize the man's devices, a forensic review confirmed the 7,000 AI-generated images. Two days after his release on bail, the man died by suicide, leaving his stepdaughter—referred to as Jane Doe 4 in court documents—with severe psychological trauma including anxiety, depression, and suicidal ideation.
Lawsuit Expansion and Additional Plaintiffs
The original complaint filed by three Tennessee teenagers earlier this year has now been joined by two additional plaintiffs from Wyoming and Wisconsin. The expanded lawsuit now includes Stability AI, the company behind Stable Diffusion, as a defendant alongside SpaceXAI. The new plaintiffs allege that perpetrators—including a plaintiff's male friend and the stepfather mentioned above—used both companies' AI models to alter and create exploitative imagery of underage individuals.
The five plaintiffs are filing claims for producing child sexual abuse material, benefiting from sex trafficking ventures, negligence, defective product design, and creating a public nuisance. Annika Martin, an attorney representing all five plaintiffs, stated that the lawsuit aims to establish protective measures to prevent similar harm across an entire generation of children. The plaintiffs are requesting that SpaceXAI and Stability AI implement more effective content filters and safeguards.

Under federal law, internet companies including AI platforms are required to report suspected child sexual exploitation to the nonprofit National Center for Missing and Exploited Children.
