The Allegations
According to prosecutors' filings, Burke met Rivas Hernandez when she was 11 years old and began sexually abusing her at age 13, when he was 18. Authorities contend he killed her at his rented Hollywood Hills residence, stabbed her multiple times, and dismembered her body using chainsaws in his garage. The prosecution claims Burke sent a vehicle to transport Rivas Hernandez from Lake Elsinore, California on April 23, 2025, the night she was killed.
Court records indicate the girl had been reported missing multiple times during the years preceding her death, and prosecutors say evidence shows she spent extended periods with Burke, including a trip to Texas where she met his family. When detectives questioned Burke about her whereabouts, he allegedly claimed they had met only once and that he was unaware she was a minor. Prosecutors state they possess sexual text messages and photos exchanged between the two.
Hearing Process and Outcome
Judge Charlaine Olmedo will determine whether the prosecution has demonstrated probable cause to move forward with trial. Burke, who was arrested in April and pleaded not guilty to murder, continuous sexual abuse of a child under 14, and unlawful mutilation of human remains, will appear in jail clothing. His attorney, Blair Berk, has maintained that Burke is not responsible for Rivas Hernandez's death.
