The Voided Settlement

US District Judge Kathleen Williams, based in the Southern District of Florida, determined that the agreement lacked legitimate legal foundation. The settlement had been reached in exchange for Trump withdrawing a $10 billion lawsuit against the Internal Revenue Service, which he filed alongside two of his sons and the Trump Organization. The cancelled "anti-weaponisation" fund was designed to compensate individuals claiming unfair government targeting, though it faced bipartisan criticism and was subsequently abandoned by the acting attorney general.

In her 56-page ruling, Williams characterised the original lawsuit as fundamentally improper. She wrote that the case "was never about a party seeking judicial resolution of a legal issue or a factual dispute" but rather represented "an attempt to use the court to provide some legitimacy to an agreement to confer immunity to people and entities affiliated with the president." The judge emphasised that because Trump controls the treasury department as president, no genuine controversy could exist between him and the IRS.

The Tax Returns Leak and Original Complaint

Trump's lawsuit centred on the unauthorised disclosure of his personal tax information by Charles Littlejohn, a former IRS contractor. The leaked documents formed the basis of a New York Times investigation published before the 2020 presidential election, revealing that Trump paid only $750 in federal income taxes during his 2016 election year and no federal income taxes across 10 of the preceding 15 years. Trump claimed the government failed to prevent this leak and sought compensation through his lawsuit.

Williams also referred one of Trump's lawyers to state authorities to determine whether ethics rule violations occurred and whether disciplinary action was warranted. The court's order prevents Trump, his sons, the Trump Organization, and the government from "using, offering, admitting, or citing" any terms of the settlement in future legal proceedings. This ruling effectively enables the IRS to pursue additional tax audits without constraint from the invalidated agreement.

Why did Judge Williams invalidate the settlement?+
Williams found the settlement was brought for an improper purpose—to manufacture judicial legitimacy for an agreement lacking legal or factual basis. She emphasised that because Trump controls the treasury department as president, no genuine legal dispute could exist between him and the IRS.

The $1.8 billion fund was designed to compensate individuals claiming they were unfairly targeted by government agencies. It was created as part of the settlement agreement but was abandoned following bipartisan backlash before the judge's ruling voided the entire deal.
Can Trump still claim immunity from tax audits?+
No. The ruling blocks both Trump and the government from citing or using any terms of the settlement in future proceedings. This allows the IRS to conduct tax audits of Trump without constraint from the invalidated agreement.
What triggered the leak of Trump's tax returns?+
Charles Littlejohn, a former IRS contractor, unauthorised leaked Trump's tax information. The documents were published by the New York Times before the 2020 presidential election, revealing his minimal federal tax payments.
What action did Judge Williams take against Trump's lawyers?+
Williams referred one of Trump's lawyers to state authorities to determine whether ethics rules were violated and whether disciplinary action was warranted based on the lawyer's conduct in the case.
