The Cost Assessment Challenge

With the main case concluded, attention has shifted to a detailed financial reckoning in the Senior Courts Costs Office. The Association of Costs Lawyers anticipates that the cost assessment process will be rigorous, with specialist judges scrutinizing every element of the publisher's legal bill. The stakes are substantial: the High Court previously deemed the claimants' initial spending plan of £39 million grossly excessive, ultimately approving only £4.1 million for their side and £4.4 million for Associated Newspapers.

The financial dynamics differ significantly depending on the basis used for cost recovery. Under a standard basis—the typical approach in litigation—judges determine whether each expense is reasonable and proportionate, with winning parties usually recovering approximately 70 percent of their costs. However, Associated Newspapers is expected to pursue an indemnity basis, which could allow recovery of 85 to 90 percent of their expenses if they can demonstrate that the claimants acted outside accepted litigation norms.

Insurance and Liability Complications

The claimants had secured legal expenses insurance to mitigate the risk of covering Associated's costs, yet concerns have emerged regarding potential insurance breaches. Additionally, a late 2024 ruling established that the claimants would be jointly liable for any adverse common costs, creating financial exposure for all parties involved. The publisher is expected to request an interim payment on account of costs, which could prove significant given the complexity and extended timeline of these proceedings.

Legal experts predict the cost resolution will extend over months, drawing parallels to the Wagatha Christie libel case, where costs disputes proved similarly protracted and contentious. David Bailey-Vella of the Association of Costs Lawyers remarked that the resolution of costs will be "just as hard fought as the main claim," signaling that this phase of litigation will demand comparable resources and attention from all involved parties.
