Costco Lawsuit Settlement Offers Cash Payments to Washington Shoppers Over Misleading Emails

Washington state residents who received promotional emails from Costco between June 2021 and July 2026 may qualify for cash payments under a $14 million class action settlement. The settlement resolves allegations that Costco sent commercial emails with false or misleading subject lines advertising limited-time sales that were actually extended beyond stated deadlines. Eligible consumers can file claims through August 24 without needing to provide proof of purchase.

How the Settlement Came Together

The lawsuit, originally filed in King County Superior Court, alleged that Costco's promotional emails created false urgency with subject lines such as "Today is the last day to access Member-Only Savings" and "Hot Buys available for 5 Days Only." Plaintiffs claimed these subject lines violated Washington's Commercial Electronic Mail Act and Consumer Protection Act by suggesting sales would end on specific dates when promotions actually continued beyond those deadlines.

Costco denied any wrongdoing but agreed to settle the case to avoid the costs and uncertainties of extended litigation. Both parties conducted mediation in March 2026 and reviewed information about Costco's email marketing practices before reaching the agreement. A preliminary approval was granted in June, with a final court hearing scheduled for October 2.

Who Qualifies and How to Claim

The settlement covers anyone who was a Washington resident and received one of the qualifying commercial emails sent by Costco or on its behalf during the five-year period. Eligible class members do not need to provide proof of purchase or any additional documentation to file a claim. Payments will be distributed on a pro rata basis, meaning each person's share depends on the total number of valid claims filed and court-approved deductions from the $14 million fund.

Consumers can submit claims online or by mail through the official settlement website. Those who received a settlement notice can file using the Claim ID and PIN included with the notice. Others can complete and mail a printable claim form. The deadline for submission is August 24, with payments expected after final court approval.
