Banuelos entered Summit Malibu seeking treatment for ketamine addiction but experienced a critical medical crisis that left her with severe anoxic brain injury—damage caused by lack of oxygen to the brain. According to court filings, she now exists in a profoundly incapacitated state, occasionally opening her eyes or making vocalizations but showing no consistent responsiveness to people around her. Her attorney, James A. Morris Jr., described her condition as being "effectively frozen," unable to move any part of her body.

The lawsuit, brought by Banuelos and her mother Yesenia Lara Cooper, alleged that Summit Malibu failed to provide appropriate care and monitoring. Santa Monica Superior Court Judge Susan Bryant-Deason approved the settlement, which was necessary because Banuelos cannot manage her own legal or financial affairs. The court approval required judicial intervention due to her complete incapacity.

Summit Malibu contested the allegations, arguing that staff members lacked legal authority to force Banuelos to seek outside medical treatment and that she had repeatedly refused medical advice and prescribed medications. The facility maintained it regularly monitored her during her stay and that no evidence proved negligent conduct by its employees. However, Banuelos' legal team initially sought $1.2 million in attorney fees, which was later reduced to $1 million as part of the settlement agreement.

Morris acknowledged the case's complexity in court documents, stating that determining exactly what caused the medical emergency proved difficult. He noted that her fragile condition upon arrival—as someone struggling with ketamine addiction—complicated liability assessments. One theory raised by medical specialists suggested a latent infection potentially acquired during her time in the adult entertainment industry may have contributed to her health crisis, though this remains unconfirmed.
